A condition of a fatigue regulated vehicle is the requirement to carry three (3) portable warning triangles. Driver requested to present triangles for inspection to which they were unable to do so.
Disobey Sign / Off Route / Traveling Distance:
Travelling in a __ direction, the accused drove the above heavy vehicle along __. This section of road is a restricted road indicated by __x erected 'No Trucks' Sign\s containing information indicating the sign is applicable to heavy vehicles with a Gross Vehicle Mass of __tonne and was clearly visible to the driver who had driven directly past.
Checks on the heavy vehicle revealed the vehicle's Gross Vehicle Mass to be __kg.
Driver stopped, spoken to and stated;
The driver was not proceeding to a destination located on that section of road. There were other appropriate unrestricted roads to wit the driver should have used to reach their destination.
The accused drove the above heavy vehicle along [ROAD] in a __ direction within lane __ of __. A heavy vehicle inspection station is positioned along this length of road. Prior to the inspection station on the side of the road is an erected traffic sign indicating 'Trucks & Buses use Left Lane'. This sign ensures trucks and buses are within the appropriate lane to allow for the safe intercept by authorised officers at the inspection station.
Positioned after the heavy vehicle inspection station is an erected traffic sign indicating 'Trucks & Buses use left lane END'
Police have observed the heavy vehicle travel along the road contrary to the particular marked lane in accordance with the sign.
No obstructions were identified within the particular marked lane to exempt the driver.
Travelling in a __ direction, the accused drove the above Fatigue Regulated Heavy Vehicle which is defined as a class 2 heavy vehicle as it was towing two (2) semi-trailers in a B-Double configuration along __. This road is a two lane main arterial road within a residential area and is not an approved road for a class 2 heavy vehicle to travel on without a permit by the authority.
Vehicle stopped and driver produced an Active New South Wales Class __ Driver Licence with the picture depicting that of the driver. The driver was questioned as to why he was travelling along the roads to which he stated __. Police questioned if the driver had a permit to travel on the route to which the driver informed police he did not and was __. Driver questioned if he had conducted any enquires prior to his travels in relation to the approved routes for travel to wit he informed police __. Driver referred to the Restricted Access Vehicle (RAV) Map and NHVR Portal for future travels.

Although no movement or actual loss of the load had occurred. Had the load shifted or been dislodged resulting in a loss of load from the heavy vehicle, due to the type of load being conveyed it would NOT have been likely to have caused an appreciable safety risk or risk of damage to road infrastructure or adverse effect on public amenity.

Travelling in a __ direction, vehicle being a __VEHICLE / TRAILER DESCRIPTION was carrying a load consisting of __.
Police observed multiple pieces of loose __ escaping from the rear of the vehicle which subsequently landed on the roadway. As this hit the roadway it resulted in it bouncing and being propelled into the air. As police caught up to the vehicle, multiple pieces of the lost load struck the front of the police vehicle.
Police stopped the vehicle and upon closer inspection observed __.
The loss of this type of load causes a significant safety risk to other motorists, both at the immediate time and as a result of the load left on the road way. The load can damage other motorist's motor vehicles as it is lost and propelled off the road way, and of greater concern escalates the risk towards other motorists in an effort to avoid the loss of load. Particularly motor cycle riders where by the load left on the road increases the risk towards a fatal collision.

Travelling in a __ direction, the accused driving a heavy vehicle (TIPPER TRUCK / SEMI TRAILER) was directed into a Heavy Vehicle Inspection Station. Checks on the Heavy Vehicle revealed the vehicle to have a Gross Vehicle Mass of __ tonne. As part of the inspection, the Heavy Vehicle was subjected to a measurement of its actual Gross Vehicle Mass where the Inspectors used a calibrated set of scales. It was calculated that the heavy vehicle had an actual Gross Vehicle Mass of __ tonne being __ tonne more than permitted, therefore falling into the Minor Risk Breach Category.
Mass breaches are categorised into three categories, Minor, Substantial and Severe. A Minor Mass Risk Breach is when the contravention is less than the substantial risk breach lower limit being 105% of the maximum mass (rounded up to nearest 0.1t) or an increase of 0.5t, but not exceeding 120% of the permitted vehicle GVM.

SEMITRAILER 4.6m HIGH BY LOAD A semitrailer that together with its load, is higher than 4.3m but not higher than 4.6m and is not a class 1 vehicle may form part of a combination of a Prime Mover towing a single semitrailer, a B double, or a road train (inc B-Triple).
Freight containers may be carried under this Notice providing they are securely fastened to the carrying vehicle by twist locks. This condition applies whether the container is laden or unladen and whether certified for marine use or not.
CLASS 1 LOAD CARRYING VEHICLE If a load on an eligible vehicle can be safely loaded in more than one way, it must be loaded in a way that minimises the dimensions of the vehicle and its load to the greatest extent practicable.

Travelling in a __ direction, upon approach of the [TUNNEL / BRIDGE / STRUCTURE], the [DESCRIBE VEHICLE COMBINATION] has proceeded past a 'low clearance' sign that stipulated a measurement of __ metres.
The heavy vehicle has activated the over height sensors resulting in the closure of the [TUNNEL] for a period of __ minutes while the lanes were cleared of general traffic and the combination reversed back to the slip lane.

A Class 1 heavy vehicle, together with it's indivisible load, wider than 2500mm must comply with specific oversize requirements.

(c) stipulates 4 brightly coloured red, red and yellow, or yellow flags, each at least 450mm by 450mm, must be attached to each side of the front and rear of the vehicle or load if projecting from the front / rear of the vehicle.
(d) stipulates that if a load projects beyond a side of a vehicle, two brightly coloured red, red and yellow, or yellow flags, each at least 450mm by 450mm, must be attached to the front and rear of each projecting side of the load at the outermost points.
Subsequently the Class 1 vehicle together with it's load contained within the boundaries of the vehicle would require a total of FOUR flags. When the load projects beyond a side of the vehicle a total of EIGHT flags are required.
The driver is required to comply with this clause as the vehicle was not travelling within 1km of a construction site for the repair / construction of a road, is not a tractor nor a rigid mobile crane less than 3.1m wide.

The driver is required to comply with this clause as the vehicle was not travelling within 1km of a construction site for the repair / construction of a road, is not a tractor nor a rigid mobile crane less than 3.1m wide.
Travelling in a __ direction, the heavy vehicle was stopped by police where it was observed that the vehicle WAS conspicuously displaying an 'OVERSIZE' sign on the FRONT &/or REAR of the vehicle. Throughout the course of the inspection, police observed the heavy vehicle was not being used under a dimension exemption. Subsequently, the vehicle must not display 'Oversize' warning signage in accordance with Section 134(1) of the Heavy Vehicle National Law (NSW) 2013.

Police have intercepted the Class 1 heavy vehicle obtaining the following measurements.
A measurement of the vehicles deck revealed its width to be __mm.
The load was protruding over the sides of vehicle's deck where a measurement of the indivisible load revealed it's total width to be __mm.

The New South Wales Class 1 Load Carrying Vehicle Operators Guide stipulates that an eligible vehicle that is wider than 2.5 metres or longer than 22 metres must not travel within the NSW Urban Zone on any classified State road between Monday and Friday (except on a state-wide public holiday) between the hours of 5:30am and 9:00am and between 4:00pm and 6:00pm.
Subsequently, the Class 1 Heavy Vehicle should not have been operating and resulted in [TRAFFIC IMPACT]

The [low loader semitrailer is fitted with five axles] and is required to comply with the Multi-State Class 1 Load Carrying Vehicle Dimension Exemption Notice 2023. As part of this notice the driver may only operate on NSW OSOM Load Carrying Vehicles Network Approved Routes and must comply with the NSW Class 1 Load Carrying Operators Guide.
Part B of the New South Wales Class 1 Load Carrying Vehicle Operators Guide stipulates that the conditions are in addition to all conditions within Part A of the guide. Part A stipulates that an eligible vehicle that is wider than 2.5 metres or longer than 22 metres must not travel within the NSW Urban Zone on any classified State road between Monday and Friday (except on a state-wide public holiday) between the hours of 5:30am and 9:00am and between 4:00pm and 6:00pm.
Additionally the combination is not eligible to travel within the [TUNNEL NAME] as the Tunnel is a Limited Access Location requiring the driver to obtain a permit to travel on.

Heavy Vehicle parked contrary to __x 'No Parking' Signs with specific conditions displayed on the sign, 'Motor vehicles under 4.5t GVM exempted'. The engine of the heavy vehicle was not running and no person was in or near the vicinity of the heavy vehicle. No sign observed on or within the heavy vehicle to indicate the vehicle to be broken down or exempt, nor hazard lights activated.
All parking signs are clearly visible and not obscured. The location has many other public areas for both light and heavy vehicles to park in however, is generally occupied by heavy vehicles due to the industrial area. Subsequently light vehicle parking is very limited.
