The Heavy Vehicle National Law does provide a defence for the accused to take a split rest while operating under BFM hours. A split rest is where a driver takes 6 continuous hours at one time and 2 continuous hours another time in a 24-hour period, rather than the required 7 continuous hours of rest. The defence only applies if the accused had at least the required 7 continuous hours of rest in the previous 24-hour period and did not schedule the split rest.

In accordance with Schedule 2 of the Heavy Vehicle (Fatigue Management) National Regulation (NSW) and the instructions contained within the driver's work diary on page 28 under Basic Fatigue Management Table 4: Solo Drivers, clearly states, 'In any period of 24 hours, a driver must not work for more than a MAXIMUM of 14 hours work time and must have the rest of that period off work with at least a minimum rest break of __ continuous hours stationary rest time.'

Inspection of the work diary revealed the driver was undertaking a fatigue regulated journey / had last undertaken a fatigue regulated journey on the __. The produced work diary contained records for only the last __ days with page 00 of the work diary dated __.

The driver was requested to produce their previous work diary however was unable too stating __.

In accordance with Section 293(1) the driver is to ensure their work diary records the required information in accordance with Subdivision 2 for each day in the previous 28 days and that the work diary is in the driver's possession while driving a fatigue regulated heavy vehicle.
